1. Introduction
Sawhorn LLC (“Company,” “we,” “us,” or “our”) operates the Not My Dent! mobile application (the “App”). This Privacy Policy explains what information the App collects, how it is used, how it is stored and protected, and what choices you have regarding your data.
This Privacy Policy applies to the Not My Dent! App available on the Apple App Store. The App may be made available on additional platforms in the future, at which time this Privacy Policy will be updated accordingly. This Privacy Policy does not apply to third-party websites, applications, or services that may be linked from within the App.
By downloading, installing, or using the App, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with these practices, please do not use the App.
2. Information We Collect
2.1 Information You Provide Voluntarily
The App does not require account creation. However, you may optionally provide the following information so that it appears on your generated PDF reports:
- Name: Your first and last name, if you choose to enter it
- Mailing Address: Your mailing address, if you choose to enter it
This information is stored locally on your device within the App’s sandboxed storage and, if you enable iCloud backup, in your personal iCloud Drive container. It is not transmitted to our servers. It is included in reports only if you choose to enter it.
2.2 Information Collected Through App Features
When you use the App, the following data may be collected and processed entirely on your device based on the features you use:
- Photographs: Images you capture using the App’s guided photo scan workflow for exterior walk-around and interior documentation. Photos are saved exclusively within the App’s sandboxed storage (Documents/ScanPhotos/) as JPEG files. The App does not save photos to your device’s Camera Roll or Photo Library.
- VIN Data: Vehicle Identification Numbers captured via on-device optical character recognition (Apple Vision/VisionKit) or entered manually. VIN barcodes are scanned on your device. The decoded VIN number is transmitted to the National Highway Traffic Safety Administration (NHTSA) public database to retrieve vehicle details (year, make, model). No other data is sent with this request. The Company does not receive, store, or process your VIN data.
- License Plate Data: License plate numbers detected via on-device optical character recognition (Apple Vision/VisionKit). License plate detection is performed entirely on your device and license plate data is never transmitted to the Company or any third party.
- Location Data (GPS): With your permission, the App accesses your device’s location services (Apple CoreLocation) to auto-populate rental location information and embed GPS coordinates into your vehicle condition reports. Location data is processed on your device and is not transmitted to our servers.
- Map and Location Search Data: The App uses Apple MapKit to provide location search and auto-population of rental pickup/return locations. MapKit requests are processed by Apple in accordance with Apple’s privacy policy.
- Timestamps and Device Metadata: The App records the date and time from your device’s system clock when photos are captured. This metadata is stored locally alongside your photos.
- Vehicle and Rental Information: Vehicle details (year, make, model), rental company name, rental location, and any notes you enter into the App. This data is stored locally on your device.
- Dent/Blemish Tags and Annotations: User-initiated tags marking areas of concern on vehicle photographs, including visual markers and text notes. This data is stored locally on your device.
- Rental Lifecycle Data: The App maintains a local database tracking rental status (active, completed, archived), scan sessions (initial pickup and return drop-off), and associated metadata.
2.3 Information We Do Not Collect
We want to be clear about what we do not do:
- We do not require or collect email addresses, phone numbers, or login credentials
- We do not collect payment or financial information through the App (purchases are processed entirely by Apple)
- We do not track your browsing activity or behavior across other apps or websites
- We do not collect your device’s advertising identifier (IDFA)
- We do not use third-party analytics SDKs, advertising SDKs, or tracking frameworks within the App
- We do not transmit your photographs, license plate data, GPS coordinates, or scan data to our servers or any third party. The only external transmission is your decoded VIN number to NHTSA for vehicle identification, as described in Section 2.2
3. How We Use Your Information
The information processed by the App is used solely for the following purposes:
- Report Generation: To compile your photos, location data, timestamps, VIN data, license plate data, rental information, dent/blemish tags, and any personal information you enter into structured PDF vehicle condition reports
- App Functionality: To provide the core features of the App, including guided photo capture, VIN scanning, license plate detection, location auto-population, dent/blemish tagging, side-by-side photo comparison, rental lifecycle management, and report export
- On-Device OCR Processing: To scan and interpret VIN barcodes and license plates using Apple Vision/VisionKit, processed on your device
- VIN Lookup: To transmit your decoded VIN number to the NHTSA public database to retrieve vehicle year, make, and model. This is the only data transmitted outside your device by the App.
- iCloud Backup (Optional, Pro Only): If you upgrade to Pro and enable the App’s iCloud backup feature, your on-device database and associated photographs are backed up to your personal iCloud Drive container. See Section 5 for details.
We do not use your data for advertising, marketing, profiling, or any purpose other than providing the App’s core functionality.
4. Data Storage and Security
4.1 Local Sandboxed Storage
All data generated by the App — including photos, reports, personal information you enter, VIN data, license plate data, location data, dent/blemish tags, rental records, and metadata — is stored locally within the App’s sandboxed storage on your device. Photos are stored as JPEG files in the App’s Documents directory. We do not operate servers that receive, store, or process your App data.
4.2 Security
Because your data is stored locally on your device within the App’s sandboxed storage, its security depends on your device’s security features, including your passcode, Face ID, Touch ID, and iOS encryption. We strongly recommend that you:
- Use a strong passcode or biometric lock on your device
- Keep your device’s operating system up to date
- Enable device encryption (enabled by default on iOS devices)
- If using iCloud backup, secure your Apple ID with two-factor authentication
5. iCloud Backup
The App offers an optional in-app iCloud backup feature, available to users who have purchased the Pro upgrade, that writes your on-device database and associated photographs to a dedicated iCloud Drive container linked to your Apple ID. This is a separate, app-specific backup — it is not the same as your device’s general iCloud backup.
5.1 What Is Backed Up
When you enable the App’s iCloud backup feature, the following data is written to your iCloud Drive container:
- All photographs captured through the App
- Your rental database (vehicle details, rental company, location, dates, scan sessions, lifecycle status)
- VIN data, license plate data, and GPS coordinates associated with your rentals
- Dent/blemish tags, annotations, and notes
- Your name and mailing address, if you entered them
5.2 Your Control and Our Limitations
You acknowledge and agree that:
- iCloud backup is optional and must be enabled by you within the App
- iCloud backup depends entirely on your Apple ID, your iCloud account configuration, and your available iCloud Drive storage
- The Company has no access to, control over, or responsibility for data stored in your iCloud Drive container
- The Company cannot remotely access, retrieve, modify, or delete your iCloud backup data
- Data stored in your iCloud Drive container is governed by Apple’s privacy policy and iCloud terms of service, not by this Privacy Policy
- You are responsible for ensuring your iCloud account has adequate storage and is properly configured
- The Company does not guarantee that iCloud backup will successfully preserve all data, that backup data will be recoverable, or that restored data will be complete or uncorrupted
- If you delete the App, your iCloud Drive backup data may persist in your iCloud account until you manually delete it from iCloud Drive
5.3 iCloud Backup Settings
You can enable or disable the App’s iCloud backup feature within the App’s settings. You can also manage or delete the App’s iCloud Drive data through your device’s Settings > [Your Name] > iCloud > Manage Account Storage, or through iCloud.com.
6. Data Sharing and Third Parties
6.1 We Do Not Share Your Data
We do not sell, rent, trade, or otherwise disclose your personal information or App data to any third party. Specifically:
- We do not share data with advertisers or ad networks
- We do not share data with data brokers
- We do not share data with analytics providers within the App
- We do not share data with rental car companies, insurers, or any other third party
- We do not “sell” or “share” your personal information as those terms are defined under the California Consumer Privacy Act (CCPA), the Virginia Consumer Data Protection Act (VCDPA), or similar state consumer privacy laws
6.2 User-Initiated Sharing
The App allows you to export PDF reports and share them with third parties (such as rental companies, insurers, or personal contacts) at your own discretion using your device’s native sharing features. Once you share a report, the recipient’s handling of that data is governed by their own privacy practices, not ours. We are not responsible for how third parties use reports you choose to share.
6.3 Apple Services
The App uses the following Apple services, which may process certain data according to Apple’s privacy policies:
- Apple Vision/VisionKit: Processes VIN and license plate images on-device for optical character recognition. No image data is transmitted to Apple for this purpose.
- Apple CoreLocation: Provides GPS coordinates. Location data may be processed by Apple’s location services according to Apple’s privacy policy.
- Apple MapKit: Provides map display and location search. Search queries and map interactions are processed by Apple according to Apple’s privacy policy.
- Apple iCloud Drive: If you enable the App’s backup feature, data is stored in your iCloud Drive container and governed by Apple’s iCloud terms.
- Apple Built-In Analytics: The App uses Apple’s built-in analytics and crash reporting to collect aggregated, anonymized usage data and crash reports. This data is collected and processed by Apple in accordance with Apple’s privacy policy and is used solely to improve App performance and stability. No personally identifiable information is collected through analytics.
6.4 NHTSA Vehicle Database
The App transmits decoded VIN numbers to the National Highway Traffic Safety Administration’s (NHTSA) public API to retrieve vehicle year, make, and model. This is the only data the App transmits outside your device (apart from iCloud backup if enabled). No personally identifiable information is included in the VIN lookup request. NHTSA’s handling of this data is governed by federal government privacy policies.
6.5 Website Analytics (Separate from App)
Our website (notmydent.com) uses Google Analytics to understand website traffic and usage patterns. Google Analytics collects information such as your IP address, browser type, pages visited, and time spent on the site. This data is collected by Google and governed by Google’s privacy policy. Website analytics are entirely separate from the App and do not affect any data within the App. No data flows between the website’s analytics and the App.
6.6 Legal Obligations
Because we do not collect or store your App data on our servers, we generally cannot disclose it even if required by law. However, we may disclose any information we do possess if required by law, subpoena, court order, or governmental regulation, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
7. Device Permissions
The App requests the following device permissions. Each permission is used solely for the stated purpose:
- Camera: Required to capture photographs of vehicle condition during guided scan workflows. The App accesses your device’s camera only when you actively initiate a photo capture. We do not access your camera in the background. Photos are saved exclusively within the App’s sandboxed storage and are not written to your Camera Roll or Photo Library.
- Location Services (GPS): Used to auto-populate rental location data and embed GPS coordinates into your reports, helping establish where photos were taken. You may deny or revoke location permission at any time in your device’s Settings. If denied, the App will function normally but reports will not include location information and rental location auto-population will be unavailable.
The App does not request access to your Photo Library, Contacts, Microphone, or any other device permissions beyond Camera and Location Services.
You can manage all permissions at any time through your device’s Settings > Privacy & Security.
8. Children’s Privacy
The App is intended for users who are at least 18 years of age. We do not knowingly collect personal information from children under 13 (or under 16 in jurisdictions where a higher age of consent applies).
If we become aware that a child under 13 has provided personal information through the App, we will take steps to delete that information promptly. If you believe that a child has provided us with personal information, please contact us at
.
9. Your Rights and Choices
Because your data is stored locally on your device and in your personal iCloud Drive container (if backup is enabled), and is not transmitted to our servers, you have direct control over your data at all times:
- Access and Review: You can view all data stored by the App directly within the App at any time, including all photographs, rental records, tags, and annotations
- Deletion: You can delete individual rentals, photos, or all App data at any time within the App. Uninstalling the App will permanently delete all locally stored data. iCloud Drive backup data must be deleted separately from your iCloud account.
- Export: You can export your data as PDF reports at any time using the App’s export feature
- Location Permission: You can enable or disable location services for the App at any time in your device’s Settings
- Camera Permission: You can revoke camera access at any time in your device’s Settings
- iCloud Backup: You can enable or disable the App’s iCloud backup feature within the App’s settings at any time
State Consumer Privacy Laws: If you are a resident of a state with a comprehensive consumer privacy law (such as California, Virginia, Colorado, Connecticut, or others), you may have additional rights under applicable law, including the right to know what personal information is collected, the right to delete personal information, the right to correct inaccurate personal information, and the right to opt out of the sale or sharing of personal information. Because we do not collect your data on our servers, do not sell your data, and do not share your data with third parties as defined under these laws, these rights are largely satisfied by the App’s local-only data architecture. If you wish to exercise any rights or have questions, please contact us at
.
10. Data Retention
All App data is stored on your device within the App’s sandboxed storage and persists until you delete it within the App or uninstall the App. We do not retain any user data on our servers because we do not collect it.
If you uninstall the App, all locally stored App data is permanently deleted from your device. If you have enabled the App’s iCloud backup feature, your backup data will persist in your iCloud Drive container until you manually delete it. The Company cannot remotely delete your iCloud Drive backup data. You are responsible for managing and deleting your iCloud Drive data through your device’s Settings or iCloud.com.
Aggregated, anonymized data collected through Apple’s built-in analytics cannot be used to identify you and may be retained indefinitely.
11. Do Not Track Signals
The App does not track users across third-party websites or services and does not respond to Do Not Track (DNT) signals because no tracking occurs within the App.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. If we make material changes, we will notify you by updating the “Last Updated” date at the top of this policy and, where practicable, providing notice through the App.
We encourage you to review this Privacy Policy periodically. Your continued use of the App after any changes constitutes your acceptance of the updated Privacy Policy.
